MyChart Terms and Conditions

You (the user) are being provided an account in the Epic MyChart information system ("MyChart") through Emory Healthcare ("Emory") solely to provide information that Emory needs to administer the COVID-19 vaccine to the user.  To obtain a MyChart account for this purpose, the user must agree to be bound by these Terms and Conditions (“Terms”) to access the questionnaires, forms, consents, and scheduling information related to the user’s COVID-19 vaccine. If the user does not agree to these Terms, the user should not use MyChart.

Please note that Terms may be updated from time to time and ask that the user periodically review this page to ensure familiarity with the most current version of these Terms. The most current version of these Terms will be posted on this page.

Appropriate Use

Access to the MyChart system is granted to the user for the sole purpose of obtaining a COVID-19 vaccine and completing the information Emory needs to provide the COVID-19 vaccine to the user.  Use of MyChart unrelated to this purpose may result in the suspension or termination of access privileges. Improper activities include, but are not limited to, the use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently cancelled, and other activities that are deemed to cause a disruption to Emory in the sole discretion of Emory.

The user may not permit any other person to access their MyChart account using their username and password.   The security of the user’s password and the use of their account, including all activities that occur under the user’s login, is the user’s responsibility.  If the user learns or suspects that their username or password has been wrongfully disclosed or used, the user should immediately reset their password and notify Emory.

MyChart may contain links to related websites not managed by Emory. These website links are for the user’s informational purposes only. Emory does not endorse and has not verified the accuracy of the information in/on these websites

Minor Eligibility

A user must be age 18 or older to request a MyChart account.

Privacy

Emory places considerable emphasis on the privacy of patient information and their compliance with privacy laws.  Emory treats information submitted by the user in accordance with its Notice of Privacy Practices.  MyChart is configured to be secure from unauthorized access and information is treated with the same degree of confidentiality as all other confidential medical information, but Emory cannot be held responsible for:

  • Unauthorized disclosure resulting from a user not logging out of an active session;
  • Unauthorized disclosure resulting from a lost or stolen user ID and password;
  • Unauthorized disclosure resulting from information printed by the user from MyChart;
  • Unauthorized disclosure resulting from personal computer settings or installed software products that may compromise information security; or
  • Similar events outside the substantial control of Emory.

 

Neither Emory nor any physician nor any affiliate, member, manager, officer, director, agent, employee or representative (collectively, “Representatives”) of Emory will be liable for any loss or damage arising from the user’s failure to comply with this provision. 

Medical Information

MyChart is an information management tool used here only to assist the user in obtaining a COVID-19 vaccine.  The information provided on MyChart is not medical advice.  The user and their provider are responsible for treatment decisions.  Consequently, the user should always seek the advice of their physician or other qualified health provider concerning any questions the user may have about any information on MyChart.  Specifically, if the user is suffering from urgent medical issues, the user should contact their clinic, physician or 911 services immediately by phone. 

Prohibited Uses 

 

The user may use their MyChart account only for lawful purposes and in accordance with these Terms. The User agrees not to use MyChart:

  • In any way that violates any applicable law or regulation;
  • To send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms;
  • To impersonate or attempt to impersonate Emory or any other person or entity (including, without limitation, by using email addresses associated with any of the foregoing);
  • Use any robot, spider, or other automatic device, process, or means to access MyChart for any purpose, including monitoring or copying any of the material on MyChart;
  • Use any manual process to monitor or copy any of the material on MyChart, or for any other purpose not expressly authorized in these Terms, without our prior written consent;
  • Use any device, software, or routine that interferes with the proper working of MyChart;
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of MyChart or any server, computer, or database connected to Emory; 
  • Attack MyChart via a denial-of-service attack or a distributed denial-of-service attack; and
  • Otherwise attempt to interfere with the proper working of MyChart.

 

Intellectual Property Rights 

 

MyChart and its entire contents, features, and functionality (including, but not limited to, all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Epic and/or Emory, its licensors, artists, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

 

These Terms permits the user to use MyChart for the user’s personal, non-commercial use only. The user must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on MyChart, except as follows:

  • The user’s computer may temporarily store copies of such materials in RAM incidental to their accessing and viewing those materials;
  • The user may store files that are automatically cached by their web browser for display enhancement purposes; and
  • The user may print or download a copy of the documents in MyChart for the user’s own personal, non-commercial use and not for further reproduction, publication, or distribution.

 

The user must not:

  • Modify copies of any documents in MyChart;
  • Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials in MyChart; and 
  • Access or use MyChart for any commercial purposes.

 

No right, title, or interest in or to MyChart or any content on MyChart is transferred to the user, and all rights not expressly granted are reserved by Emory and Epic.  Any use of MyChart not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.

 

Termination

If Emory believes, in its sole discretion, that the user has violated these Terms, Emory reserves the right to immediately terminate the user’s access to MyChart, in addition to any other remedies available at law. 

 

Disclaimer of Warranties

 

EMORY CANNOT GUARANTEE ACCESS TO MYCHART AT ALL TIMES DUE TO SYSTEM FAILURES, BACK-UP PROCEDURES, MAINTENANCE, OR OTHER CAUSES.   MYCHART IS PROVIDED BY EMORY ON AN "AS IS" AND "AS AVAILABLE" BASIS. EMORY MAKES NO REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE AVAILABILITY OF MYCHART, THE OPERATION OF MYCHART OR THE INFORMATION, CONTENT, OR DATA INCLUDED ON OR PROVIDED THROUGH MYCHART.  THE USER EXPRESSLY AGREES THAT THE USER’S USE OF MYCHART IS AT THE USER’S SOLE RISK.

 

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, EMORY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EMORY DOES NOT WARRANT THAT MYCHART OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NEITHER EMORY NOR ANY REPRESENTATIVE OF EMORY WILL BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF MYCHART, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO THE USER, AND THE USER MIGHT HAVE ADDITIONAL RIGHTS.

Emory assumes no responsibility, and IS not liable for any damage to, or virus or other harmful code that may affect the user’s computer equipment or other property based on the user’s access to, or use of, MyChart.  This also applies to the downloading of any objects from MyChart.

Indemnification

 

The user agrees to indemnify and hold Emory, all medical providers whose information is provided in MyChart, and each of their respective Representatives harmless from any claims, demands, losses, damages, fees, or penalties, and the cost to investigate and defend the same, including reasonable attorneys’ fees, made by the user, any federal or state agency, or any third party due to or arising out of the use of MyChart, or the breach of these Terms or a violation of privacy laws by the user or anyone accessing MyChart on the user’s behalf.

 

Governing Law

These Terms shall be governed by the laws of Georgia without giving effect to any choice or conflict of law provision or rule.

 

Effective Date

The effective date of these Terms is March 26, 2021.
